That's pretty impossible. It really depends on the drivers auto policy coverages. Say he has a 15k limit...thats the most they will offer. With this type of accident, you really should get a lawyer. Bodily Injury does not cover passengers in the car which caused the accident. Essentially, the driver is not liable for causing your injury since you were a passenger in his/her car. If the vehicle was a taxi, bus, or other commercial entity, it would be a different story.
He/she is not responsible for your injuries if the car is in an accident. If his/her policy has medical coverage, it can be used for passengers in the vehicle. However, medical is an optional coverage only and the standard coverage for it is around $5,000.
